In consideration of participating at Empyrean Arts, LLC, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the Activity. I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or in-actions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releasees" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activity. I hereby release, discharge, and covenant not to sue Empyrean Arts, LLC, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsor, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the "Releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim. I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement of assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect. I confirm that I am participating in any and all AradiaTM Fitness USA and Empyrean Arts classes for personal use only and I acknowledge that the classes I am participating in are not structured or intended to prepare anyone to be a pole dance, aerial arts, contortion, or fitness instructor. Only individuals who have been accepted into and completed the AradiaTM Fitness and/or Empyrean Arts certification program are legally able to teach AradiaTM Fitness and/or Empyrean Arts classes and/or any portion of an AradiaTM Fitness and/or Empyrean Arts class. AradiaTM Fitness and/or Empyrean Arts will pursue legal action against any person teaching any AradiaTM Fitness and/or Empyrean Arts classes or any portion of original AradiaTM Fitness and/or Empyrean Arts choreography that does not have a valid certification.

Location and Arrival - The Empyrean Arts studio entrance is located on the right side (the west side) of the 32 Banks Avenue building under a covered patio with our window decals on the outside. Plan to arrive to the studio 10-15 minutes before your scheduled class, providing enough time to park, get dressed and ready for class. Students arriving late to the studio will not be allowed to attend class and will not be refunded. We have a dressing room located within the studio and cubbies by the front door for your belongings. Bathrooms and water fountain are located in our building in the communal hallway that we share with our neighboring businesses. We have a variety of snacks, drinks, and other merchandise available for purchase near the entrance. Parking - Empyrean Arts offers two different free parking lots for students and staff, one is a gravel lot located directly in front of Vortex Doughnuts, and the second is a large gravel lot on the northwest corner of Church Avenue and Banks Avenue. There is also free street parking on Banks Avenue, Coxe Avenue, and the other surrounding streets. Drop in Students - We accept walk-in (drop in) students in the event that there is space available in class. We strongly encourage students to sign up through our online system ahead of time to ensure a spot in class. Cancellations - If within two hours of a scheduled class there are two students or less signed up, Empyrean Arts reserves the right to cancel the class. Students will not be charged for a class that they are signed up for if Empyrean should need to cancel due to low sign ups, instructor emergency, or inclement weather. That class credit will simply go back into your student account for future use. If you should need to cancel a class or private lesson reservation, please do so at least 12 hours before the scheduled appointment to avoid losing that class credit. If you are unable to cancel before the 12 hours leading up to your class reservation, you will lose that class credit. Classes - Empyrean classes are non-refundable and non-transferable, meaning they cannot be refunded or gifted to another student. To pay for a class for someone else, you may either purchase a gift certificate or purchase the class with your credit card under their account. Be mindful of expiration dates as they are not extendable. Expiration dates start when you make a purchase. Expiration dates and more information on class pricing can be found under the "Pricing" tab on our website. Private Lessons & Parties - Private lessons and parties must be paid for in full in advance to reserve studio and instructor time. Empyrean Arts can schedule your private lesson or party for you via email at firstname.lastname@example.org, text, or phone 828.782.3321. Private parties must give a cancellation notice of at least 48 hours for a full refund. Spectators - All students present in classes, private lessons, workshops, and parties must complete registration and payment prior to the start of the scheduled appointment. Visitors are not permitted to watch group classes, private lessons, workshops, or parties. Open Studio - Open studio is a fabulous time where any one can come to the studio and train, play, stretch, and meet other students. There is no teaching and/or student to student skill sharing during an open studio. If you have a question/concern about a skill that you learned in class, feel free to ask the open studio host. Only trained staff members may rig or handle aerial equipment, ask for assistance from a staff member if you need equipment adjusted for you. Cameras, Videos, Notes, Etc - Written notes are encouraged as electronic devices are not permitted during group class time. Please respect others privacy in the studio. Pictures and/or videos are permitted during the following times: Private Lessons (per instructor approval), Parties, Open Studio, Private Studio Rental, and the 10 minutes directly following a Group Class (before the start of the next class). Youth Classes - Students under the age of 18 must be accompanied by a parental guardian to sign a consent waiver upon their first studio visit or have their parental guardian complete a student account for them online through our website. All group classes are for students ages 12 and up. On occasion, a teacher may make exceptions for particularly mature students. Attire - For all beginning level classes at Empyrean wearing capri length leggings and a t-shirt or tank top that does not have any metal parts like zippers or buttons on it are perfect attire for class. As students progress in pole classes, shorts are preferred for a better grip on the pole. Wear class appropriate attire in the studio, and be fully clothed when entering and exiting the studio grounds. Wearing undergarments only is not allowed during pole activities. Street shoes must be removed before entering the classroom. Pole heels and "dressing up" are always optional and welcome if desired. Behavior - Anyone under the influence of alcohol or drugs are not permitted in the studio. Disrespectful behavior is unacceptable at the studio and Empyrean firmly stands behind our mission of providing a safe and supportive environment for anyone wishing to visit the studio.
